YOUR ACCESS TO AND USE OF THE FISHTANK WEB TOOL IS CONDITIONED ON YOUR ACCEPTANCE OF AND COMPLIANCE WITH THESE TERMS. BY ACCESSING, BROWSING, OR USING THE WEBSITE, YOU AND YOUR EMPLOYEES, SUB-CONTRACTORS AND AGENTS ARE DEEMED TO ACCEPT AND AGREE TO BE BOUND BY THESE TERMS OF USE.

FISHTANK is an online platform providing specialized tools for fire engineering. Access to features is tiered based on user status:

  • Public Features: Certain tools and resources are available for use by all visitors without an account.
  • Members-Only Features: Advanced tools require a free account registration to access.
  • Full Access: Professional-grade features and saved scenarios require an active paid subscription.

FISHTANK reserves the right to modify access tiers, pricing, and available tools at any time without prior notice.

FISHTANK (including any of its agents) makes no warranty expressed or implied, to users, and accepts no responsibility for use of the website or its calculation tools. In no event shall FISHTANK, or its principals, shareholders, officers, employees, affiliates, contractors, subcontractors, subsidiaries, or parent organizations, be liable for any incidental, consequential, or punitive loss, costs or damages of any nature whatsoever including but not limited to physical injury, loss of life, damage to health, financial loss, damage to property relating to the supply to use or reliance on FISHTANK and howsoever arising.

Users assume sole responsibility under all applicable laws for determining the appropriateness of the website's use in any particular application; for any conclusions drawn from the results of its use; and for any actions taken or not taken as a result of analyses performed using these tools.

Users are warned that FISHTANK is intended for use only by those competent in the fields of fluid dynamics, thermodynamics, combustion and heat transfer and is intended only to supplement the informed judgement of such users. The web tools are based on computer models that may or may not have predictive capability when applied to a specific set of factual circumstances. Lack of accurate predictions by the model could lead to erroneous conclusions with regard to fire safety. All results should be evaluated by an informed professional.

The user acknowledges that the tools cannot be guaranteed to be error-free and further acknowledges that the existence of any such errors shall not constitute a breach of these terms.

Permitted Uses

Access to FISHTANK is provided for professional use by qualified practitioners. Registered accounts and subscriptions are personal to the user (or the licensed firm) and must not be shared, re-sold, or used in connection with an online service bureau. The user must ensure that its employees, sub-contractors and other agents who have authorised access to the platform are made aware of these terms.

This Agreement is the complete statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings. This Agreement shall be governed by the laws of Australia and using this website constitutes a submission to the non-exclusive jurisdiction of the High Court of Australia and/or the Supreme Court of New South Wales.

All rights of any kind in FISHTANK which are not expressly granted in these Terms are entirely and exclusively reserved to and by the developers of FISHTANK. You may not scrape, modify, translate, reverse engineer, decompile, or create derivative works based on the platform without express written permission.

The user shall not permit any act which infringes the copyright of FISHTANK. The user indemnifies FISHTANK fully against all liabilities, costs and expenses which FISHTANK may incur to a third party as a result of the user’s breach of the copyright or usage provisions of this agreement.

Any breach of these terms will result in immediate termination of access. Failure or neglect to enforce any of these provisions shall not be construed or deemed to be a waiver of that party’s rights.
